[EN+DE] Another win against Cycle Logistics!

Wage theft is real and there’s only one cure: reach out to your colleagues and organise against bosses who think that stealing wages from the people that create their profits is a zero-risk endeavour! Yesterday, we won yet another case against Cycle Logistics in the Berlin labour court. The judge found in favour of our comrade for the lion’s share of the case, i.e. the falsely claimed minus hours, and our member will be paid his rightfully earned wages. We didn’t succeed in claiming the lesser part (holiday payments that were not granted), but all in all: it was two steps forward and one step back. Like a metaphor for organising at the workplace.

If you ever feel you’ve been left to face your problems alone at work, contact us! The union is there to help you negotiate and we will do everything in our power to solve the issue. We will negotiate, we will picket and we will go public. And as a last resort, we will also go to court. Because sometimes that’s necessary to show companies that next time they think it’s a good idea to not pay workers their wages, they need to be careful. If we win, they’ll have to pay not only the outstanding wages, but the court fees as well. Ignoring basic workers rights is not risk-free, not with us.

One last thing: join the union BEFORE the situation gets bad. It’s an act of solidarity towards us as an organisation and other workers who stand up against exploitation. The Workplace Group at Cycle Logistic did it, and so can you.

Wieder gegen Cycle Logistics gewonnen!

Lohndiebstahl ist real, und es gibt nur ein Mittel dagegen: verbünde dich mit deinen Kolleg:innen und organisiere dich gegen die Chef:innen, die glauben, dass sie den Menschen, die ihre Gewinne erwirtschaften, risikolos den Lohn stehlen können!

Vorgestern haben wir einen weiteren Prozess gegen Cycle Logistics vor dem Berliner Arbeitsgericht gewonnen. Der Richter hat unserem Mitglied in der Hauptsache, dass heißt bei den zu Unrecht geltend gemachten Minusstunden, Recht gegeben. Unser Mitglied bekommt seinen rechtmäßigen Lohn ausgezahlt. Die nicht gewährte Urlaubsabgeltung haben wir nicht durchsetzen können, aber alles in allem: zwei Schritte vor und einen zurück. Wie eine Metapher für das Organisieren am Arbeitsplatz.

Wenn du das Gefühl hast, dass du bei der Arbeit mit deinen Problemen allein gelassen wirst, wende dich an uns! Die Gewerkschaft ist dafür da, dich bei Verhandlungen zu unterstützen. Wir werden alles in unserer Macht stehende dafür tun, um das Problem zu lösen. Wir werden verhandeln, demonstrieren und an die Öffentlichkeit gehen. Als letztes Mittel werden wir auch vor Gericht ziehen.

Manchmal ist das notwendig, um den Unternehmen zu zeigen, dass sie das nächste Mal vorsichtig sein müssen, wenn sie es für eine gute Idee halten, Arbeiter:innen um ihren Lohn zu prellen. Wenn wir gewinnen, müssen die Unternehmen nicht nur die ausstehenden Löhne zahlen, sondern auch die Gerichtskosten. Die Missachtung grundlegender Arbeitsrechte darf für Unternehmen nicht ohne Risiko sein – nicht mit uns.

Eine letzte Sache noch: Trete in die Gewerkschaft ein, BEVOR sich die Situation verschlechtert. Das ist ein Akt der Solidarität mit uns als Organisation und anderen Arbeitnehmer:innen, die sich gegen Ausbeutung wehren. Die Betriebsgruppe bei Cycle Logistic hat dies getan, und du kannst das auch.

For close to a year, workers at Cycle Logistics have been organising against wage theft. Workers found missing hours on their invoices, reduced paychecks, and in some cases, no paychecks at all.

After months of worsening conditions and the management unwilling to listen, workers decided to demand their missing wages in court.

Seit fast einem Jahr wehren sich die Beschäftigten bei Cycle Logistics gegen Lohndiebstahl. Auf ihren Lohnabrechnungen fehlten Stunden, Löhne wurden gekürzt und in einigen Fällen überhaupt nicht gezahlt.

Nach Monaten sich verschlechternder Arbeitsbedingungen und der Ignoranz des Managements, klagen die Beschäftigten ihre Löhne jetzt vor Gericht ein.

[EN+DE] Termination overturned at Cycle Logistics GmbH

Workers at Cycle Logistics GmbH have won a major victory when after a 6 month court process the labor court in Berlin overturned the illegal termination of an organizer/Works Council member.

Workers at Cycle Logistics GmbH, also known as Velogista, have been fighting for better workplace conditions since at least 2020. Their demands included sanitation basics such as access to running water and a working toilet, as well as work days within the legal limit, and an end to payment iregularities. After management appeared unwilling to hear or address worker concerns, the workers decided to elect a Works Council. The workers group at Cycle Logistics GmbH began organizing this election process with the help of the FAU Berlin in Feburary of 2021. Coinciding with the election process Cycle Logistics Gmbh management attempted to terminate one of the initiators and Works Council candidates, under the pretense of “contract violations”.

Following this, there were more attempts to disrupt or influence the Works Council election results, but ultimately these attempts failed and the election succeeded. Four of the candidates received the overwhelming majority of the votes from the workforce. These four included the worker which management attempted to fire presumably in response to the election, in what appears to be a clear instance of union busting.

Today, following a 6 month court process, the illegal termination has been thrown out and the Workers Council is now finally whole again. The Workers’ fight for self determination remains undeterred.

“This termination was clearly not legal, I think the boss even knew that at the time he issued it”, said the returning worker when asked about their return to to the workplace and council. “Unfortunately it seems management succeeded in temporarily disrupting our fight for better conditions. But thankfully my fellow workers, including those on the Council, have stood clearly against these disruptive efforts. I am grateful to them and look forward to getting back to working side by side. I see this as a clear example of how an attack on an individual worker was used to try to hurt the fight for better conditions for all. But we also see how persistence and workers standing by one another can win.”

With at multiple other lawsuits against Cycle Logistics GmbH in various stages the fight for proper working conditions at Cycle Logistics CL GmbH has only just begun. Today’s victory is a big step forward, and we look forward to seeing more of their actions in the workplace soon.

Kündigung bei Cycle Logistics GmbH gekippt!

Die Beschäftigten der Cycle Logistics GmbH haben einen wichtigen Sieg errungen: Nach einem sechsmonatigen Gerichtsverfahren hat das Arbeitsgericht Berlin gestern die rechtswidrige Kündigung eines Genossen aufgehoben.

Die Genoss*innen der Cycle Logistics GmbH, auch bekannt als Velogista, kämpfen seit mindestens 2020 für bessere Arbeitsbedingungen. Zu ihren Forderungen gehören sanitäre Grundlagen wie der Zugang zu fließendem Wasser und einer funktionierenden Toilette, Arbeitstage innerhalb der gesetzlichen Grenzen sowie ein Ende der Zahlungsunregelmäßigkeiten. Nachdem sich die Unternehmensleitung nicht bereit gezeigt hatte, die Anliegen der Arbeiter*innen anzuhören oder darauf einzugehen, beschlossen sie, einen Betriebsrat zu wählen. Die Betriebsgruppe der Cycle Logistics GmbH begann im Februar 2021, unterstützt von der FAU Berlin, damit, den Wahlprozess zu organisieren. Zeitgleich mit Beginn dieses Vorgangs versuchte die Geschäftsführung der Cycle Logistics GmbH, einen der Initiatoren und Betriebsratskandidaten unter dem Vorwand der “Vertragsverletzung” zu kündigen.

Im Laufe der Zeit erfolgten noch weitere Versuche, die Betriebsratswahl zu stören oder zu beeinflussen. Sie scheiterten jedoch, die Wahl wurde erfolgreich durchgeführt. Vier der Kandidaten erhielten die überwältigende Mehrheit der Stimmen aus der Belegschaft. Unter diesen vier befand sich auch der Arbeiter, den die Unternehmensleitung, möglicherweise als Reaktion auf die Wahl, zu entlassen versuchte – was ein klarer Fall von Gewerkschaftsfeindlichkeit wäre.

Gestern, nach einem sechsmonatigen Gerichtsverfahren, wurde die rechtswidrige Kündigung verworfen, und der Betriebsrat ist nun endlich wieder vollständig. Der Kampf der Arbeiter*innen für ihre Selbstbestimmung ist ungebrochen.

“Diese Kündigung war eindeutig nicht rechtens, ich glaube, der Chef wusste das sogar, als er sie aussprach”, so der zurückkehrende Arbeiter auf Nachfrage. “Leider scheint es dem Management gelungen zu sein, unseren Kampf für bessere Bedingungen vorübergehend zu unterbrechen. Aber zum Glück haben sich meine Kolleg*innen, einschließlich derjenigen im Rat, klar gegen diese Störversuche gestellt. Ich bin ihnen dankbar und freue mich darauf, wieder Seite an Seite arbeiten zu können. Für mich ist dies ein deutliches Beispiel dafür, wie mit einem Angriff auf einen einzelnen Arbeiter versucht wurde, dem gesamten Kampf für bessere Bedingungen zu schaden. Aber wir sehen auch, wie Beharrlichkeit und das Zusammenstehen der Arbeiter*innen zu einem Sieg führen können.”

Update about the last few months:

The Workers Group at Cycle Logistics CL GmbH succeeded in establishing a Betriebsrat despite the desperate attempts by the company to disrupt or influence the process.

Now, with the works council in place, we have defended several workers from arbitrary termination. This means the workers can fight back with another layer of protection.

The Case Details

Why was the worker fired?

  • No reason was provided to the worker either verbally or in writing at the time of the termination (17th March 2021). Even when asked by the judge, management only provided the vague explanations that the worker “violated his contract” and that the worker “failed to express his ideas for future cooperation.” However no further clarifications nor justifications were provided.
  • This pattern indicates union-busting. As management is unable to provide concrete justifications for termination, it is reasonable to assume that Cycle Logistics CL GmbH wanted to block the formation of a Betriebsrat. Once the company found out the worker was helping his colleages to organize, management began harassing him to leave the company. When the worker began the election for a Betriebsrat, management issued a termination immediately afterwards.

But wait, isn’t it illegal to fire someone for starting a Betriebsrat?

  • It is! It’s actually a criminal offense, punishable by up to a year in prison (Betrvg § 119), and a deep violation of the democratic rights of workers.

So what is the outlook of the case?

  • Flawless conduct by the worker. No tangible reason for termination. Additional termination protection from the Betriebsrat election. A clear pattern of harassment and retribution from Cycle Logistics CL GmbH because of the worker’s advocacy on behalf of the staff. This case couldn’t be more clear that the termination was illegal. But nothing is 100% certain until the judge makes the decision.

Why is this case important?

  • It is hard to find a clearer instance of an employer trying to intimidate workers and change the composition of a Betriebsrat. This is union-busting and it cannot be tolerated in any workplace. Workers have the fundamental right to associate and unionise. From a small company like Cycle Logistics CL GmbH to large startups like Gorillas Technologies GmbH, we see companies try to attack workers organising. This shows that companies are scared of how powerful workers are when they unite!

Warum wurde unser Genosse entlassen?

Gute Frage! Zum Zeitpunkt der Kündigung (17. März) wurde unserem Mitglied weder mündlich noch schriftlich ein Grund genannt. Selbst auf Nachfrage des Richters gab das Management nur die vage Erklärung ab, dass der Arbeitnehmer eben “gegen seinen Vertrag verstoßen” und es versäumt habe, “seine Vorstellungen von einer künftigen Zusammenarbeit zu äußern”. Weitere Erklärungen oder Begründungen wurden nicht geliefert.

Das deutet auf einen Versuch von Union Busting hin: Das Management scheint nicht in der Lage zu sein, konkrete Begründungen für die Kündigung zu liefern – und das widerum legt nahe, dass Cycle Logistics CL GmbH die Gründung eines Betriebsrats zu verhindern versucht. Genau ab dem Zeitpunkt nämlich, an dem das Unternehmen von den Organisierungsbemühungen unseres Mitglieds erfuhr, wurde es bedrängt, das Unternehmen zu verlassen. Als sich die Vorgänge hin zur Betriebsratswahl konkretisierten, wurde ihm schließlich die Kündigung ausgesprochen. Zufall?

Aber Moment mal, ist es nicht illegal, jemanden zu feuern, weil er einen Betriebsrat gegründet hat?

Ist es! Es ist sogar eine Straftat, die mit bis zu einem Jahr Gefängnis geahndet wird (Betrvg § 119), und ein schwerer Verstoß gegen die demokratischen Rechte der Arbeitnehmer*innen.

Wie sind die Aussichten vor Gericht?

Einwandfreies Verhalten des Arbeiters, kein greifbarer Grund für die Kündigung, zusätzlicher Kündigungsschutz durch die Betriebsratswahl, ein klares Muster von Schikanen und Vergeltungsmaßnahmen wegen des Eintretens des Arbeiters für die Belegschaft – in diesem Fall könnte nicht klarer sein, dass die Kündigung rechtswidrig ist. Aber nichts ist zu 100 % sicher, bis die*der Richter*in eine Entscheidung getroffen hat.

Was ist der Stand im Betrieb?

Der Betriebsgruppe Cycle Logistics ist es gelungen, einen Betriebsrat zu gründen – trotz verzweifelter Versuche des Unternehmens, den Prozess zu stören und zu beeinflussen. Durch den Betriebsrat konnten schon mehrere Arbeiter*innen vor willkürlichen Kündigungen geschützt werden und haben nun ein weiteres Tool an der Hand, mit dem sie sich zur Wehr setzen können.

Warum ist dieser Fall wichtig?

Ein Chef, der versucht, Arbeiter*innen einzuschüchtern und die Zusammensetzung eines Betriebsrats zu ändern oder ihn gar zu verhindern sowie Dynamiken des Union Busting können in keinem Betrieb toleriert werden. Die Arbeiter*innen haben das grundsätzliche Recht, sich zu vereinigen und gewerkschaftlich zu organisieren. Von kleinen Unternehmen wie Cycle Logistics CL GmbH bis hin zu großen Start-ups wie Gorillas Technologies GmbH sehen wir, wie Unternehmen versuchen, Arbeiter*innen anzugreifen, wenn sie sich organisieren. Das zeigt, dass sie Angst davor haben, wie mächtig die Arbeiter*innen sind, wenn sie sich zusammenschließen!

Velogista riders are facing repression while organizing for basic rights

On Tuesday the 23rd of February a small rally was held by the FAU Berlin outside of the Cycle Logistics (which also works under the name Velogista) depot in Kreuzberg. Members of the FAU had gathered to support the worker’s group at Cycle Logistics GmbH who are actively fighting for better conditions at their workplace. The employer has ignored multiple letters from the FAU asking for a collective answer to the problems and has up until this point resisted dealing with the problems in the company collectively as demanded by the worker’s group.

The rally lasted for an hour and a half, flyers were handed out, good coversation were made with the staff and laughs shared. It was the first action in support of the Cycle Logistics workers group but bigger and more frequent actions will happen unless the demands of the worker’s group are acted upon. 
The worker’s group are asking for an open, transparent and collective process for dialogue with the owner of the company. Many issues have been raised in recent months but the biggest at the moment regards the attempted wage theft due to unjustifiable minus hours as well as the lack of transparency in how these calculations have been made. At the very least we ask Velogista at a minimum to follow the basic legal law in regards to this matter and to deal with this, with the workers as a group and not to target individual workers and push them into possibly detrimental personal arrangements.
As a grassroots trade union, we believe workers are stronger when they stand together. We stand up for adequately paid, safe and fair working conditions for everyone. Like all couriers in the city of Berlin and beyond, the staff at Cycle Logistics Gmbh face day to day hardships and work in all weather conditions whether it’s the deepest darkest winter or the warmest days in Summer as well as working for the entirety of the pandemic. They deserve to be treated with dignity and respect and have their basic conditions met by their employer. 
The FAU along with other grassroots unions all over the world has been helping couriers self organise and fight for what they deserve, the struggle with Cycle Logistics Gmbh is just one link in the chain in the struggle for all delivery workers for better working condititions. 
We stand in solidarity with the Cycle logistics workers group and will continue to provide the support they need to fight for their rights as well as better working conditions in the future!
